| 1287 حَدَّثَنَا الحَسَنُ بْنُ عَلِيٍّ الحُلْوَانِيُّ الخَلَّالُ قَالَ : حَدَّثَنَا أَبُو أُسَامَةَ ، عَنْ الوَلِيدِ بْنِ كَثِيرٍ قَالَ : حَدَّثَنَا بُشَيْرُ بْنُ يَسَارٍ ، مَوْلَى بَنِي حَارِثَةَ ، أَنَّ رَافِعَ بْنَ خَدِيجٍ ، وَسَهْلَ بْنَ أَبِي حَثْمَةَ ، حَدَّثَاهُ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَهَى عَنْ بَيْعِ المُزَابَنَةِ الثَّمَرِ بِالتَّمْرِ ، إِلَّا لِأَصْحَابِ العَرَايَا ، فَإِنَّهُ قَدْ أَذِنَ لَهُمْ ، وَعَنْ بَيْعِ العِنَبِ بِالزَّبِيبِ ، وَعَنْ كُلِّ ثَمَرٍ بِخَرْصِهِ : هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ غَرِيبٌ مِنْ هَذَا الوَجْهِ |
That the Prophet (ﷺ) said: Whoever enters an orchard then let him eat, but not take any in his garment.
[He said:] There are narrations on this topic from 'Abdullah bin 'Amr, 'Abbad bin Shurahbil, Rafi' bin 'Amr, 'Umair the freed slave of Abi Al-Lahm, and Abu Hurairah.
[Abu 'Eisa said:] The Hadith of Ibn 'Umar is Gharib Hadith. We do not know of it from this route except from Yahya bin Sulaim. Some of the people of knowledge have permitted the wayfarer to eat from the fruits, and some of them disliked it without paying.
1303- Rafi' b. Hadîç (r.a.) ve Sehl b. Hasme'den rivâyet edildiğine göre Rasûlullah (s.a.v.): "Müzabene satışını yani yaş hurmanın kuru hurma karşılığında satışını yasakladı sadece "Arâyâ" sahiplerine izin verdi. Aynı şekilde yaş üzümü kuru üzümle ve her meyveyi tahmin yoluyla alıp satmaktan yasakladı." (Ebû Dâvûd, Büyü'; 21 ; İbn Mâce, Ticarat: 55) ® Tirmîzî: Bu hadis bu şekliyle hasen sahih garibtir.
