باب إذا اشترط شروطا في البيع لا تحل
| 2085 حَدَّثَنَا عَبْدُ اللَّهِ بْنُ يُوسُفَ ، أَخْبَرَنَا مَالِكٌ ، عَنْ هِشَامِ بْنِ عُرْوَةَ ، عَنْ أَبِيهِ ، عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا ، قَالَتْ : جَاءَتْنِي بَرِيرَةُ فَقَالَتْ : كَاتَبْتُ أَهْلِي عَلَى تِسْعِ أَوَاقٍ ، فِي كُلِّ عَامٍ وَقِيَّةٌ ، فَأَعِينِينِي ، فَقُلْتُ : إِنْ أَحَبَّ أَهْلُكِ أَنْ أَعُدَّهَا لَهُمْ ، وَيَكُونَ وَلاَؤُكِ لِي فَعَلْتُ ، فَذَهَبَتْ بَرِيرَةُ إِلَى أَهْلِهَا ، فَقَالَتْ لَهُمْ فَأَبَوْا ذَلِكَ عَلَيْهَا ، فَجَاءَتْ مِنْ عِنْدِهِمْ وَرَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ جَالِسٌ ، فَقَالَتْ : إِنِّي قَدْ عَرَضْتُ ذَلِكَ عَلَيْهِمْ فَأَبَوْا إِلَّا أَنْ يَكُونَ الوَلاَءُ لَهُمْ ، فَسَمِعَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَأَخْبَرَتْ عَائِشَةُ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ : خُذِيهَا وَاشْتَرِطِي لَهُمُ الوَلاَءَ ، فَإِنَّمَا الوَلاَءُ لِمَنْ أَعْتَقَ ، فَفَعَلَتْ عَائِشَةُ ، ثُمَّ قَامَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي النَّاسِ ، فَحَمِدَ اللَّهَ وَأَثْنَى عَلَيْهِ ، ثُمَّ قَالَ : أَمَّا بَعْدُ ، مَا بَالُ رِجَالٍ يَشْتَرِطُونَ شُرُوطًا لَيْسَتْ فِي كِتَابِ اللَّهِ ، مَا كَانَ مِنْ شَرْطٍ لَيْسَ فِي كِتَابِ اللَّهِ فَهُوَ بَاطِلٌ ، وَإِنْ كَانَ مِائَةَ شَرْطٍ ، قَضَاءُ اللَّهِ أَحَقُّ ، وَشَرْطُ اللَّهِ أَوْثَقُ ، وَإِنَّمَا الوَلاَءُ لِمَنْ أَعْتَقَ |
Aisha said, Buraira came to me and said, 'I have agreed with my masters to pay them nine Uqiyas (of gold) (in installments) one Uqiya per year; please help me.' I said, 'I am ready to pay the whole amount now provided your masters agree that your Wala will be for me.' So, Buraira went to her masters and told them about that offer but they refused to accept it. She returned, and at that time, Allah's Messenger (ﷺ) was sitting (present). Buraira said, 'I told them of the offer but they did not accept it and insisted on having the Wala.'.' The Prophet (ﷺ) heard that. `Aisha narrated the whole story to the Prophet . He said to her, Buy her and stipulate that her Wala' would be yours as the Wala' is for the manumitted. `Aisha did so. Then Allah's Messenger (ﷺ) stood up in front of the people, and after glorifying Allah he said, Amma Badu (i.e. then after)! What about the people who impose conditions which are not in Allah's Book (Laws)? Any condition that is not in Allah's Book (Laws) is invalid even if they were one hundred conditions, for Allah's decisions are the right ones and His conditions are the strong ones (firmer) and the Wala' will be for the manumitted.
D'après 'Urwa, 'A'icha (radiallahanho) dit: Barîra vint me voir et me dit: Je viens de conclure avec mes maîtres un contrat d'affranchissement stipulant le payement de neuf 'uqiyya; une 'uqiyya en chaque année. Veuxtu m'aider. — Si tes maîtres le veulent bien, lui disje, je leur donnerai cette somme; à condition que le droit de patronage me revienne. Sur ce, Barîra alla voir ses maîtres mais ceuxci refusèrent la proposition. Alors elle les quitta et revint me voir tandis que le Messager d'Allah (salallahou alayhi wa sallam) était assis [chez moi]. Elle dit: Je leur ai fait la proposition mais ils insistent d'avoir le droit de patronage. Le Prophète (salallahou alayhi wa sallam) entendit ces paroles. Aussitôt, 'A'icha informa le Prophète (salallahou alayhi wa sallam) qui lui dit: Prendsla et exige d'eux d'avoir le droit de patronage! car ce droit revient à celui qui affranchit. En effet, 'A'icha fit la chose. Après quoi, le Messager d'Allah (salallahou alayhi wa sallam) se leva pour faire un discours aux fidèles. Il loua Allah et Lui rendit grâce puis il dit: Cela dit, qu'ontils, quelques gens, à exiger des conditions ne se trouvant pas dans le Livre d'Allah. Toute condition ne se trouvant pas dans le Livre d'Allah est nulle, même s'il s'agit de cent conditions. Le jugement d'Allah est plus juste et la condition d'Allah est plus solide. Quant au droit de patronage, il revient à celui qui affranchit.
':'Telah menceritakan kepada kami 'Abdullah bin Yusuf telah mengabarkan kepada kami Malik dari Nafi' dari 'Abdullah bin 'Umar radliallahu 'anhu bahwa 'Aisyah Ummul Mu'minin radliallahu 'anha berkehendak untuk membeli seorang budak wanita lalu dibebaskannya. Tuannya berkata: 'Kami jual kepada anda namun perwaliannya tetap menjadi hak kami. Kemudian kejadian ini diceritakan kepada Rasulullah shallallahu 'alaihi wasallam. Maka Beliau bersabda: 'Janganlah menghalangi kamu persyaratan mereka itu karena sesungguhnya perwalian (seorang budak) adalah untuk yang memerdekakannya'.'
| 2086 حَدَّثَنَا عَبْدُ اللَّهِ بْنُ يُوسُفَ ، أَخْبَرَنَا مَالِكٌ ، عَنْ نَافِعٍ ، عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا ، أَنَّ عَائِشَةَ أُمَّ المُؤْمِنِينَ أَرَادَتْ أَنْ تَشْتَرِيَ جَارِيَةً فَتُعْتِقَهَا ، فَقَالَ أَهْلُهَا : نَبِيعُكِهَا عَلَى أَنَّ وَلاَءَهَا لَنَا ، فَذَكَرَتْ ذَلِكَ لِرَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ : لاَ يَمْنَعُكِ ذَلِكَ ، فَإِنَّمَا الوَلاَءُ لِمَنْ أَعْتَقَ |
Aisha, (mother of the faithful believers) wanted to buy a slave girl and manumit her, but her masters said that they would sell her only on the condition that her Wala' would be for them. `Aisha told Allah's Messenger (ﷺ) of that. He said, What they stipulate should not hinder you from buying her, as the Wala' is for the manumitted.
'Abd Allah ibn 'Umar (radiallahanho): 'A'icha, la Mère des croyante, voulut acheter une esclave pour ensuite l'affranchir. Mais les maîtres de celleci lui dirent: Nous te la vendons à condition de garder le droit de patronage. Et 'A'icha d'aller informer le Messager d'Allah (salallahou alayhi wa sallam) sur la chose. Mais il lui dit: Cela ne peut t'empêcher..., le droit de patronage revient à celui qui affranchit.
':'Telah menceritakan kepada saya Abu Al Walid telah menceritakan kepada kami Al Laits dari Ibnu Syihab dari Malik bin Aus bahwa dia mendengar 'Umar radliallahu 'anhu dari Nabi shallallahu 'alaihi wasallam bersabda: 'Jual beli beras dengan beras adalah riba' kecuali begini-begini (kontan cash) gandum dengan gandum adalah riba' kecuali begini-begini (kontan cash) kurma dengan kurma adalah riba' kecuali begini-begini (kontan cash) '.'
